Desvendando o Limbo Previdenciário: Quando a incapacidade encontra a
injustiça.

Sabia que você está preso no limbo previdenciário? Você é um empregado incapaz de

O “limbo previdenciário” é um termo frequentemente utilizado para descrever a

devido a doenças ou lesões e dependem desses benefícios para sobreviver.
As causas mais comuns para o limbo previdenciário incluem, em primeiro lugar, a
burocracia excessiva nos órgãos previdenciários, juntamente com a demora na análise
dos processos, especialmente os mais complexos.
Em segundo lugar, o grande volume de solicitações no INSS e a falta de servidores e de
um sistema tecnológico eficiente para automatizar as atividades da Autarquia. Mesmo
sendo 100% digital, o órgão ainda não possui estrutura para atender à demanda dentro
do prazo legal determinado pela lei, resultando em injustiças.
Em terceiro lugar, acontece quando o empregado recebe alta médica do INSS e a
empresa, com base em uma avaliação médica, atesta sua incapacidade laboral, recusar-
se a reintegrar o empregado ao trabalho, ocorre o chamado limbo previdenciário. No
entanto, a empresa não pode agir assim, recusando-se a fornecer trabalho e forçando o
empregado a enfrentar uma situação de limbo previdenciário, no qual ele fica à própria
sorte, sem receber salários ou benefícios previdenciários.
Legalmente, a empresa assume os riscos da atividade econômica, incluindo os riscos do
contrato de trabalho, e, portanto, é sua responsabilidade pagar os salários devidos aos
seus empregados, independentemente do nexo causal da doença adquirida pelo
trabalhador. Assim, a empresa deve pagar os salários simplesmente em razão da alta
médica concedida pelo INSS, independentemente da efetiva utilização da mão de obra
do empregado.

Portanto, a empresa não tem o direito de decidir unilateralmente se manterá o vínculo de
emprego sem exigir trabalho do empregado; ela deve cumprir todas as suas obrigações
decorrentes do contrato, incluindo o pagamento dos salários.
Por outro lado, é dever do empregado, ao ter seu auxílio-doença indeferido, se
apresentar formalmente à empresa e ficar à disposição, inclusive realizando exames de
retorno ao trabalho. Se for considerado inapto pelo médico da empresa, é obrigação
desta disponibilizar meios adequados para o retorno ao trabalho, ou até mesmo adaptá-
lo a outras funções. Caso a empresa se recuse a pagar o salário, o empregado deve
procurar imediatamente um advogado previdenciário para garantir seus direitos na
justiça.
É importante ressaltar que, caso a empresa se recuse a receber o empregado, este deve
guardar todos os documentos que comprovem seu retorno ao trabalho dentro do prazo
estabelecido de 30 dias para evitar ser demitido por justa causa.
Mas, se o INSS e o médico da empresa considerarem que o empregado está apto a
voltar ao trabalho, e o médico particular ou do SUS que acompanha o caso afirmar que
ele não está em condições de retornar, surge uma situação delicada.
Normalmente, o empregado é convocado para retornar ao trabalho e, mesmo incapaz,
acaba voltando, correndo o risco de se acidentar no ambiente laboral. Nesses casos, é
comum a empresa convocar o trabalhador e, em seguida, demiti-lo, pois não tem
interesse em manter um empregado doente ou incapacitado. Para evitar essa situação, é
necessário que o empregado procure imediatamente um advogado previdenciário para
resguardar seus direitos.
Caso o segurado receba alta previdenciária e haja atestado de saúde
ocupacional (ASO) do médico do trabalho declarando inaptidão, pode
protocolar recurso administrativo no INSS, visando reverter a decisão de
cancelamento do benefício.

Também deve procurar um advogado especialista em previdenciário para ajuizar ação
previdenciária requerendo o restabelecimento do benefício cessado ou negado,
cumulada com pedido de concessão de tutela de urgência.
